Terms of Service for My Vet Jobs

Welcome to My Vet Jobs!

These Terms of Service ("Terms") govern your access to and use of the My Vet Jobs website (https://myvetjobs.com.au/) and its related services (collectively, the "Service"). The Service is an online job board connecting veterinary professionals ("Job Seekers") with employers ("Employers") in the Australian veterinary industry.

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

1. Description of Service

My Vet Jobs provides a platform where:

Employers can post job advertisements for roles within the Australian veterinary sector.
Job Seekers can search, browse, and view these job advertisements.
The Service facilitates connection by providing job details and links for Job Seekers to apply directly to Employers via external websites. My Vet Jobs does not process job applications directly.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the right, authority, and capacity to enter into these Terms.

3. Employer Accounts & Responsibilities

Account Creation: Employers need to provide accurate information (organization name, contact details, etc.) to post jobs. You are responsible for maintaining the confidentiality of any account credentials.
Job Postings: Employers are solely responsible for the content of their job postings, including accuracy, completeness, and compliance with all applicable Australian laws and regulations (e.g., employment law, anti-discrimination law, advertising standards).
- Job postings must be for legitimate employment opportunities within the veterinary field in Australia.
- You must clearly state the job requirements, location, employment type, and provide a valid external URL for applications (apply_url). Salary information is optional but encouraged.
- You grant My Vet Jobs a license to display, format (including creating structured data for SEO), and distribute your job posting and any associated logos (hiring_organisation_logo) on the Service.
- You warrant that you have the necessary rights to use and grant us the license for any logos or content submitted.
Prohibited Content: Job postings must not contain misleading information, discriminatory requirements (unless legally justifiable), links to malicious sites, or requests for sensitive personal information beyond what is standard for a job application.
Fees: Posting a job requires payment as specified on the Service (currently AUD $99.00 for a 30-day listing, subject to change).

4. Job Seeker Use

Searching & Browsing: Job Seekers can search and browse job listings anonymously.
Applying for Jobs: Applications are submitted directly to the Employer via the external link (apply_url) provided in the job posting. My Vet Jobs is not involved in the application or hiring process. We are not responsible for the content of external sites or the Employer's application process.
No Guarantee: My Vet Jobs does not guarantee that Job Seekers will find suitable positions or be contacted by Employers.

5. Fees and Payment

Posting Fees: Employers agree to pay the applicable fees for job postings as displayed at the time of purchase. All fees are in Australian Dollars (AUD) and are non-refundable unless otherwise required by law.
Payment Processing: Payments are processed securely through our third-party payment processor, Stripe. By making a payment, you agree to Stripe's terms and conditions. My Vet Jobs does not store your full credit card details.
Listing Duration: Standard job postings are active for 30 days from the date of successful payment and publication.

6. Content and Intellectual Property

Our Content: The Service itself, including its design, text, graphics, code (like the Django framework elements mentioned), and underlying technology, is the property of My Vet Jobs or its licensors and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service or included software.
Employer Content: Employers retain ownership of the content they submit (job descriptions, logos). However, they grant My Vet Jobs the necessary license to use this content to provide the Service, as described in Section 3.
Job Seeker Interaction: Interactions and applications submitted via external links are between the Job Seeker and the Employer.

7. Use Restrictions

You agree not to:

Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
Scrape, data mine, or systematically collect data from the Service without express written permission.
Interfere with or disrupt the Service, its servers, or networks (e.g., by transmitting viruses or harmful code).
Attempt to gain unauthorized access to the Service or user accounts.
Use automated systems (like bots) to access the Service in a way that sends more request messages to the servers than a human can reasonably produce in the same period using a conventional web browser (note: we use tools like Google reCAPTCHA to help prevent this).
Misrepresent your identity or affiliation with any person or organization.
Post spam or irrelevant content.

8. Third-Party Services & Links

The Service integrates with or links to third-party services, including:
- Stripe: For payment processing.
- Simple Analytics: For privacy-focused website analytics.
- Google reCAPTCHA: To prevent spam and abuse.
- Employer Application URLs: Links provided by Employers for job applications.
Your use of these third-party services is subject to their respective terms and privacy policies. My Vet Jobs is not responsible for the practices or content of these third parties or external websites linked in job postings.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
MY VET JOBS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
MY VET JOBS DOES NOT SCREEN OR CENSOR JOB POSTINGS AND IS NOT INVOLVED IN THE ACTUAL TRANSACTION BETWEEN EMPLOYERS AND JOB SEEKERS. WE MAKE NO REPRESENTATIONS ABOUT THE TRUTHFULNESS, ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF JOB POSTINGS OR EMPLOYER CONTENT.
WE ARE NOT RESPONSIBLE FOR THE HIRING DECISIONS MADE BY ANY EMPLOYER USING THE SERVICE. WE DO NOT GUARANTEE JOB PLACEMENT FOR ANY JOB SEEKER OR SUITABLE CANDIDATES FOR ANY EMPLOYER.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MY VET JOBS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (c) ANY CONTENT OBTAINED FROM THE SERVICE; OR (d) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF MY VET JOBS EXCEED THE GREATER OF ONE HUNDRED AUSTRALIAN DOLLARS (AUD $100.00) OR THE AMOUNT YOU PAID MY VET JOBS, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless My Vet Jobs, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, any content you submit (like job postings or logos), your use of any information obtained from the Service, or your violation of any law or the rights of a third party.

12. Privacy

Our collection and use of personal information in connection with the Service are described in our Privacy Policy.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
Employers may stop using the Service at any time, although fees paid are non-refundable. Job listings will expire naturally after their term.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Queensland, Australia, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the courts located within Queensland, Australia to resolve any dispute or claim arising from these Terms or the Service.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the new Terms on the Service or by other means (like email, if applicable). Your continued use of the Service after such changes constitutes your acceptance of the new Terms. We encourage you to review the Terms periodically.
